I don't know that it matters how the original scribes understood it in this case. This describes a time during which there were no people. Even in the best possible circumstance we're already relying on people to scribe something they could not possibly witness or understand.

@Ben - the right to privacy is in play only because the court first rejected any individual rights for the fetus. The right to privacy in question is then balanced vs the state's interest in preserving the population and the species.
